In recent days, support for death penalty took such a blow.  On March 7, 2011, the US Supreme Court, in Skinner v. Switzer, held that Texas death row inmate, Hank Skinner, cannot be executed until lower courts hear his demand that several items from the crime scene, including a rape kit from the victim and two knives used in the attack, be tested for DNA.

This is hardly a get-out-of-jail card for Skinner – he’ll still have to overcome myriad legal objections to his demand for testing of DNA evidence. What the decision means for Skinner – and others similarly situated – is that he will at least have another day in court.

Skinner’s case isn’t unique.  According to the Innocence Project, the premier national organization that assists prisoners who could be proven innocent through DNA testing, 17 people on death row have been exonerated by DNA evidence thus far, in addition to the 267 people in the US who have been exonerated by DNA testing.  Furthermore, public sentiment has begun to shift regarding death penalty, according to the Death Penalty Information Center.  The number of death sentences has continually dropped for the seventh consecutive year as of 2009; the number is now the lowest it has been since the Supreme Court re­instated the death penalty in 1976. 11 states considered abolishing the death penalty recently, citing high costs (due to death row appeals paid for by the taxpayer) and lack of measurable benefits in lowering or deterring crime, the most often cited reasons for the death penalty in the first place. New Mexico just became the 15th state to abolish it.

What all of this means is that there is a tremendous need for attorneys and paralegals across the country, especially in states where death penalty is still applied (like California and Texas), to take up habeas corpus cases (challenging the court’s authority to detain the prisoner) or cases like Skinner’s , arguing for the right to have DNA evidence examined.  The work is challenging and exciting, involving interviewing witnesses, reviewing trial records, and a good amount of detective work.  Look at the roster for the Innocence Project, and you will see many paralegals in their ranks.  With the Supreme Court opening the door just a nudge for death row inmates like Skinner, there will undoubtedly be more need for paralegals down the road, which paralegal schools can provide.  Not to mention that one would be hard pressed to obtain a paralegal job these days without formal education or a certificate – scanning the job postings for paralegals, and one will see that many of those postings require a formal paralegal training or certification, which only a paralegal school can provide.

Securities analysts are also known as financial analysts, equity analysts, or investment analysts.  Their role is that of an analyst (as the name suggests) who studies the financial performance of corporations, whether with internal or external affairs, and advises on potential investments.  This role uses fundamental analysis principles, but also incorporates chart analysis and tactical evaluations of the market environment.  Similar to components of paralegal jobs, securities analysts are responsible for studying records and filings, making conference calls and interacting with clients, they schedule meetings, write reports and make spreadsheets, make presentations, and use specialized software programs to help them with their duties.  The nature of the work is very much a system, much like the work of a paralegal.

Employment is often found in pension funds, hedge funds, securities firms, banks, insurance companies, and other types of businesses.  The securities analyst is essentially responsible for helping the company, or their clients, to make important investment decisions; they are highly trained in knowing how to manage money in such a way that is of significant benefit to the company or clients that they work for.  In a similar way, paralegals’ work is extremely beneficial, if not crucial to the well being of a law firm.

While the education requirements are not entirely specific, most securities analysts have received graduate level training in a related field.  The most common of these are an MSF (Master of Science in Finance), or an MBA.  The undergraduate portion of their education is often in a related field of some sort, as well.  So, if you are serious about making the transition from paralegal jobs to another career, and are considering becoming a securities analyst, you may need to acquire additional schooling.  If you are willing to take on additional schooling, you won’t be disappointed as securities analysts tend to make between $50,000 and $100,000 annually, with the median being towards the latter.  Chances are that if you like the type of work you do in paralegal jobs, you will also enjoy a new role as a securities analyst.

EEOC sided with the husband.  Four Federal Appeals courts disagreed, throwing out hubby’s lawsuit claiming that he had been terminated in retaliation for his fiancee’s complaint, reasoning that the law “does not permit a retaliation claim by a plaintiff who did not himself engage in protected activity.”  The US Supreme Court, on January 24, 2011, in the case Thompson v. North American Stainless, unanimously held that the fiancé/husband of an employee who filed a gender discrimination lawsuit against an employer, who happened to work at the same place of employment but takes no action to support the wife’s claims, can file a Title 7 claim for retaliatory firing after being terminated by the same employer.

For paralegal school students, you can find this clause in Section 704(a) of Title VII which prohibits an employer from retaliating against an employee because he or she “has made a charge, testified, assisted, or participated in any manner in an investigation, proceeding, or hearing under this subchapter.” Thompson did none of those things – I guess behind every strong woman is a gutless man.

The moral of this story is that it is better to engage in protected activity (ie., “…make a charge, testify, assist, or participate in an investigation”), and know that if you were to engage in the protected activity, you’ve got the mighty hand of the Law looking out for you.  And if you chicken out and prefer to keep your mouth shut, just make sure you are married or engaged to the aggrieved employee.  Or, in the worst case scenario, just don’t work in the same company as your partner when it comes time for him/her to file a lawsuit.

Loan coordinators work for organizations like banks, credit unions, universities, and corporations.  It is most desirable if you have a few years experience working as a bank clerk, teller, or loan processor.  Experience within commercial banking and real estate documentation is also beneficial.  If you are wanting to transition from a paralegal to a loan coordinator, you may need to gain a few years experience working in one of these positions in a bank.

Aside from desired experience, the duties of both paralegal jobs and loan coordinating share a lot in common.  As a loan coordinator and as a paralegal you provide administrative; in one case to the loan process, in another to the law process.  Both are responsible for processing important documents and entering data into computer software systems designed for the tasks at hand.  Both check for accuracy in documents and assemble/coordinate meetings and the forwarding of materials from one party to another; they often act as a bit of a liason between involved parties.  In addition, both paralegal jobs and loan coordinating positions are responsible for customer service to clients.

As far as work environments go; both types boast classic professionalism.  Business suites, office buildings, and formalities in communication are relevant components of working as a loan coordinator.  In either position you can expect to work 40-50 hours a week on salary without option of overtime pay.  A benefit of working in loan coordinating as opposed to paralegal jobs is the slightly higher salary.  Loan coordinators average around $44,000 annually.  Paralegals salaries average around $35,000 annually.  If you are ok with possibly having to gain a few years experience in banking and are interested in a larger salary, then making the transition from paralegal jobs to loan coordinating could be the right decision for you.

• Prepare and type up related documents
• Interview loan applicants for personal and financial data
• Assemble and compile documents for loan closings- title abstracts, insurance forms, etc.
• Record applications
• Submit applications
• Contact customers by mail, phone, and in person
• Contact credit bureaus and employers
• Calculate, review, and correct errors
• Schedule and conduct closings of mortgage transactions
• Answer questions
• Establish credit limits
• File and maintain loan records
• Accept payments on accounts
• Use computers to do many of these tasks; be sufficient in using a computer

Many of these tasks are similar to those of a paralegal working in paralegal jobs.  It is best that you have knowledge of economics and accounting, good math skills, knowledge of laws and legal procedures, experience with customer service, and well developed computer skills.  In addition you need to have interpersonal skills for dealing with customers and credit bureaus.  Work experience as a paralegal provides an excellent base and should make for an easy transition into working as a loan interviewer and clerk.
